Background
This agreement applies as between you, the User of this Web Site, and Goggle Software Ltd, the owner and operator of MySocialDash. MySocialDash is a product created, operated and maintained by Goggle Software Ltd.
Your agreement to comply with and be bound by these Terms is deemed to occur upon your first use of the Website and/or associated applications. If you do not agree, you must stop using MySocialDash immediately.
1. Definitions and Interpretation
- "Content" - any text, graphics, images, audio, video, software, data compilations and other information stored in or displayed by MySocialDash.
- "Goggle Software Ltd" - company registered in England & Wales, company number 11136456, registered office: 128 City Road, London, United Kingdom, EC1V 2NX.
- "Service" - facilities, tools, services or information made available via MySocialDash.
- "System" - any online infrastructure including dashboards, analytics, reporting, live chat and email links.
- "User" - any third party accessing MySocialDash not employed by Goggle Software Ltd in the course of employment.
- "Website" - mysocialdash.com and subdomains (*.mysocialdash.com) and *.gogglesoftware.co.uk.
2. Intellectual Property
All Content included on MySocialDash, unless uploaded by Users, is the property of Goggle Software Ltd or licensed third parties. Such material is protected by UK and international intellectual property law. You may not reproduce, copy, distribute, store or re-use material from MySocialDash without our express written permission.
3. Links to Other Web Sites
MySocialDash may contain links to other sites. Unless expressly stated, these sites are not under our control. We accept no responsibility for their content and disclaim liability for any loss or damage from their use. Links do not imply endorsement.
4. Links to This Website
You may link to the homepage of mysocialdash.com without permission. Deep links to specific pages require prior written consent. Contact [email protected].
5. Privacy
Use of MySocialDash is also governed by our Privacy Policy.
6. Disclaimers
We make no warranty that MySocialDash will meet your requirements, be fit for purpose, error-free, secure, compatible with all systems, or provide specific results. No part of MySocialDash constitutes advice. All use is at your own risk.
Where you have paid for services, no refunds are offered under any circumstances. You may close your account at any time by written notice.
7. Availability of the Website
The Service is provided "as is" and "as available". We give no warranty that it will be uninterrupted or fault-free. We accept no liability for downtime caused by ISP/host failure, power failure, natural events, war or legal restrictions.
8. Limitation of Liability
To the maximum extent permitted by law, we accept no liability for direct or indirect losses, including loss of data, profits, goodwill or reputation. Nothing excludes liability for death, personal injury due to negligence, or fraud.
9. No Waiver
Failure to exercise any right shall not be construed as a waiver of that right.
10. Payments and Offers
Payments must be made on time. Failure to pay may result in suspension or closure. No refunds are given under any circumstances, regardless of whether you used an Early Adopter code, offer code, voucher code or any discount. Features may be changed or removed at any time.
11. Previous Terms
In case of conflict with earlier versions, these Terms prevail.
12. Notices
All notices must be sent to [email protected]. Notices are deemed received the day sent (or next business day if weekend/holiday).
13. Law and Jurisdiction
These Terms and your relationship with Goggle Software Ltd shall be governed by the laws of England & Wales. Both parties submit to the exclusive jurisdiction of the courts of England & Wales.
14. Severability
If any provision is found unlawful, invalid or unenforceable, that provision will be severed and the rest shall remain valid.
15. User Content and Data Security
All content or data you upload is at your own risk. We use reasonable industry practices, but we do not guarantee against loss, corruption or unauthorised access. You must maintain your own backups.
16. Data Imports and Storage
Uploaded files (e.g. LinkedIn ZIPs) are deleted after processing. Only structured database records are retained. We do not back up your original files. You must keep your own copies.
17. Support
Support is limited due to the low-cost nature of MySocialDash. Available only via email at [email protected]. No response times are guaranteed. Support covers only system operation - not training, consulting, or data interpretation.
18. Account Security
You are responsible for keeping your account secure. We may provide email verification codes or other 2FA methods which may change. We accept no liability for breaches resulting from your failure to secure your credentials.
19. Third-Party Service Providers
We rely on:
- Cloudflare - network security & content delivery.
- DigitalOcean - hosting infrastructure.
- Postmark - email delivery.
- OpenAI - enrichment/backfilling of company industry info.
Your data may be processed by these providers outside the UK. We select reputable providers but are not liable for their acts/omissions.
20. Acceptable Use
You must not use MySocialDash to transmit spam, hack/disrupt systems, infringe rights, or breach laws. We may suspend/terminate accounts for prohibited activity.
21. Indemnity
You agree to indemnify and hold harmless Goggle Software Ltd against claims, damages or expenses arising from your use of MySocialDash, uploaded data, or breach of these Terms.
22. Force Majeure
We are not liable for failure/delay caused by events beyond our reasonable control (e.g., natural disasters, government actions, provider outages).
23. Amendments
We may update these Terms at any time. Continued use after publication of changes constitutes acceptance.
